In addition, you should make sure that you have gathered all of the information that is needed in order to prove that you are owed money. Filing small claims cases requires evidence. A small claims case involves money that is less than five thousand dollars.

In order to file a small claims case you will need to contact the Clerk of County Court. You have to file the small claims case in the county where the payment is received. You can also file the small claims case in the county where the defendant lives or where the property resides.

You need to fill out a complaint form as well. The complaint form is the Statement of Claim form that can be found in the Clerk’s office. After filing the complaint form, you should take advantage of process serving. Process serving is the best way to notify the defendant. Process servers can be paid to deliver the Service of Process and the Statement of Claim to the defendant. Process serving can be done by registered mail and does cost money.
